भारत देश भले अंगेजों से मुक्त हो गया हो लेकिन उनके बोये हुए बीज आज भी भारत में सक्रिय हैं वो जो चाहे वो करवा सकते हैं ।
आपने मीडिया में देखा होगा कि कठुआ की घटना जनवरी में घटती है और मीडिया इसका तूल अप्रैल में पकड़ता है, फिर कुछ लोग केंडल मार्च निकालते हैं, कुछ सड़कों पर आ जाते हैं और अचानक सरकार पर दबाव डालकर बलात्कार के कानून कड़े करवाने की मांग करते हैं ।
ऐसे ही 2012 में जो निर्भया कांड हुआ उसमें भी ऐसे ही हुआ था, बाद में बलात्कार के कड़े कानून बने ।
आप देखेंगे कि आये दिन बलात्कार की घटनाएं घटती रहती हैं पर उस पर मीडिया, केंडल मार्च वाले, NGOs, महिला आयोग और सेक्युलर लोग चुप रहते हैं क्योंकि उस समय उनको कोई फायदा नही दिखता। बलात्कार तो बलात्कार ही होता है चाहे किसी के भी साथ हो पर एक दो केसों को छोड़कर बाकि सभी केसों पर चुप्पी सधी रहती है ।

बलात्कार के कड़े कानून होना बहुत जरुरी है लेकिन एक तरफा नहीं, क्योंकि कई न्यायालय इस पर चिंता व्यक्त कर चुके हैं कि इसका फायदा उठाकर कई मनचली लड़कियों द्वारा इसका अंधाधुन दुरुपयोग भी किया जा रहा है ।
अब आते हैं मुख्य मुद्दे पर, 2012 में निर्भया कांड के बाद कड़े कानून बने और एक नया कानून पॉक्सो एक्ट बना । जिसमें जमानत नही मिलती । इसका सबसे पहला शिकार हुए 78 साल के हिन्दू संत आसाराम बापू । उनको 2013 में गिरफ्तार किया गया । उनके लड़खड़ाते स्वास्थ्य के बावूजद भी 5 साल तक उन्हें जमानत तक नही दी गई ।
अप्रैल 2018 में जैसे ही न्यायालय में आखरी बहस खत्म हो गई और जज जजमेंट लिखने लगे उस समय से कठुआ के केस को लेकर मीडिया, NGOs, सेक्युलर, महिला आयोग सभी ने तूल पकड़ा और बलात्कार के कड़े कानून बनवाने की मांग शुरू की और फिर से उसका पहला शिकार बापू आसारामजी हुए और उन्हें उम्रकैद की सजा सुनाई गई जबकि उन्हें मेडिकल रिपोर्ट में क्लीनचिट मिल चुकी है । पॉक्सो एक्ट के तहत चल रहे उनके केस में लड़की की सही उम्र की जांच नहीं हुई । लड़की की सही उम्र के उन सभी दस्तावेजों को जोधपुर सेशन कोर्ट के जज मधुसूदन शर्मा द्वारा अनदेखा किया गया जो सुप्रीम कोर्ट के आदेश पर बचाव पक्ष द्वारा बहस के दौरान साबित करवाएं गए थे । किसी दस्तावेज के अनुसार लड़की 19 साल की तो किसी में 20 साल की साबित हो रही है । इतना बड़ा प्रूफ जज के सामने होने पर भी बापू आसारामजी को छेड़छाड़ के आरोप में पॉक्सो एक्ट के तहत उम्रकैद की सजा सुनाई गई।

ऐसा बेहूदा फैसला सुनाकर न्यायपालिका ने अपनी गरिमा पर प्रश्नचिन्ह लगा लिया है। आज जजों ने बताया कि न्यायपालिका इतनी भ्रष्ट हो चुकी है कि जहां न्याय दिया नहीं जाता बेचा जाता है ।
आपको बता दें कि 2012 में जो नए बलात्कार के कानून बने है उसमें बलात्कार की परिभाषा ही बदल कर रख दी है । अब लड़की को स्पर्श करना भी बलात्कार में ही गिना जाता है । इससे भी बलात्कार की धारा 376 ही लगती है ।
अब केस की थोड़े गहराई में जाएं तो उसमें आया है कि लड़की कहती है कि मेरे साथ डेढ़ घंटे तक छेड़छाड़ करते रहें और मेडिकल में उसके शरीर पर एक खरोंच का भी निशान नहीं पाया गया । क्या ऐसा संभव है आज हर बुद्धिजीवी को ये जानने का अधिकार है कि कैसे एक संत को फंसाया गया है । लड़की कहती है मैं शॉक्ड थी पर जिनके यहां पर वो रुकी थी उन घर के लोगों के जब बयान लिए गए तो वो कहते हैं कि हँसी खुशी गई है हमारे यहां से । लड़की की मां कहती है कि मैं बापू आसारामजी के कमरे के बाहर बैठी थी तो उसको ऐसा नहीं हुआ कि मेरी बेटी डेढ़ घंटे से अंदर है तो मैं देखकर आऊ कि वो कहाँ है रात का समय है । आगे देखिए लड़की कहती है कि मैं चिल्लाई तो रात के सन्नाटे में उसकी माँ को उसके चिल्लाने की आवाज क्यों नहीं आई जबकि वो तो गाँव का इलाका है और सबसे बड़ी बात अगर किसी लड़की के साथ डेढ़ घंटे तक छेड़छाड़ या यौनशोषण हुआ हो तो क्या वो इतनी नार्मल रह सकती है कि बाहर बैठी उसकी माँ को बेटी का चेहरा देखकर कुछ पता ही न चले ।
क्या ऐसा संभव है ???आगे लड़की के फोन की कॉल डिटेल से पता चलता है कि वो देर रात तक किसी संदिग्ध व्यक्ति के साथ संपर्क में थी । जिस कॉल डिटेल की पुष्टि नोडल ऑफिसर ने कोर्ट में अपने बयान में की । क्या किसी लड़की के साथ इतना बड़ा हादसा होने के बाद वो फ़ोन पर आसानी से किसी से बात कर सकती है ?? एक तरफ तो लड़की कहती है मैं शॉक्ड थी दूसरी तरफ वो किसी के साथ लगातार संपर्क में थी और कोर्ट में हुए बयानों के आधार पर बापू आसारामजी रात 12:00 बजे तक सगाई फंक्शन में थे । आज तक लड़की और उसके मां-बापू के सिवा एक भी गवाह ऐसा नहीं आया न लड़की के पक्ष का और न ही बापू आसारामजी के पक्ष का, जिसने ऐसा कहा हो कि मैंने लड़की को बापू आसारामजी के कमरे में जाते देखा था ।
पर इन सभी सबूतों को जज मधुसूदन शर्मा द्वारा एक साइड पर रखकर निर्णय सुनाया गया । जिसे देखकर आम जनता का मानना है कि भारत में न्याय मिलता नहीं बेचा जाता है ।

पक्षपात पूर्ण न्याय का एक और खुलासा देखिए आरोप लगाने वाली लड़की ने बताया कि बापू आशारामजी के सेवादार शिवा ने मुझे बुलाया तो शिवा सह-आरोपी होना चाहिए । लेकिन कोर्ट ने उसको निर्दोष बरी कर दिया और बापू आसारामजी को आजीवन कारावास की सजा सुना दी । न्यायतंत्र है या कोई खेल का मैदान ?क्या आपको पता है कि जेल जाने से पहले ही डॉ. सुब्रमण्यम स्वामी ने बापू आसारामजी को बता दिया था कि वे वेटिकन सिटी के निशाने पर हैं । उन्होंने जो लाखों हिन्दुओं की #घरवासपी कराई है, आदिवासियों में हो रहे ईसाई धर्मान्तरण पर रोक लगाई है उससे वेटिकन सिटी नाराज है और आपको जेल भेजने की तैयारी कर रहे हैं । उस समय बापू आसारामजी ने इन बातों पर ध्यान नही दिया और हिंदू संस्कृति का प्रचार-प्रसार करते रहे, धर्मान्तरण पर रोक लगाते रहे, हिन्दुओं की घर वापसी करवाते रहे जिसके कारण आज उनको उम्रकैद की सजा सुननी पड़ी ।

थोड़ा पीछे जाएं तो देखेंगे कि ऐसा ही षड्यंत्र शंकराचार्य जयेंद्र सरस्वती पर भी हुआ था और उनको भी निचली अदालत ने दोषी ठहराया था फिर उच्च न्यायालय ने 9 साल के बाद निर्दोष बरी किया था पर इससे क्या वो इज्जत वो सम्मान, वो उनका कीमती समय उनका न्यायालय लौटा पाया ?
अब समाज को जागॄत होने की आवश्यकता है । मूर्ख भले इस सच्चाई को न समझें पर समझदार तो समझ ही रहे हैं कि कैसे हिंदुत्वनिष्ठों को बदनाम करके समाज को उनसे दूर करने की साजिश चल रही है । अगर अभी भी समाज सतर्क नहीं हुआ तो एक दिन ऐसा आएगा कि कोई हिन्दू संस्कृति के लिए, हिंदुओं के लिए आवाज उठाने वाला नहीं होगा ।
